It is an act of completion of a commercial activity. The seller - the provider of the goods or services - completes a sale in response to an acquisition or to an appropriation or to a request. There follows the passing of title (property or ownership) in the item, and the application and due settlement of a price, the obligation for which arises due to the seller's requirement to pass ownership. Ideally, a seller agrees upon a price at which he willingly parts with ownership of or any claim upon the item. The purchaser, though a party to the sale, does not execute the sale, only the seller does that. To be precise the sale completes prior to the payment and gives rise to the obligation of payment. If the seller completes the first two above stages (consent and passing ownership) of the sale prior to settlement of the price, the sale remains valid and gives rise to an obligation to pay. I sent him the money through paypal a couple of hours ago and have not received an email back from him yet. I do, however, have a conformation email from paypal. So how long does it generally take for a person to receive those funds through paypal? I mean, how long will it be until the seller knows that I have actually paid him? Q. I signed a contract to buy my first house, seller also signed. One week later, list agent called me that seller wanted to withdraw from this contract, no written so far. (FYI, I don't have agent.) It's time you got a lawyer, as you'll find it difficult to enforce your rights on your own. To understand your position, you need to understand the difference between "legal title" and "equitable title". Legal title is when your name is on a valid deed, and if your state requires it, that deed is recorded. Equitable title is when you have the right to receive legal title. You have equitable title now, if your contract is valid, and you keep the promises (pay the price by the date specified.) In other words, you CAN force the seller to go through with the contract as written. The relief you'd be asking for in court is "specific performance".
